PGN Pocket Terms of Use

These terms govern the use of the PGN Pocket application ("the app"). By installing and using it, you accept what is set out here. The processing of your personal data is explained separately, in the privacy policy.

This English text is a translation provided for convenience. The binding version is the Spanish original, available at pgnpocket.ia-helper-tools.com/terminos.html. In the event of any discrepancy between the two, the Spanish text prevails.

1. Who provides the service

PGN Pocket is developed and operated by IA Helper Tools (Francisco López), a sole trader based in Spain.

2. What is free and what is paid

Most of the app is free and requires no account: recording games, the board, the viewer, variations and comments, the store of your opponent's games, the explorer, PGN export and the settings.

Only two features are paid, because each use has a real cost:

2 bis. Early phase: we are not charging right now

During the early phase, the AI features are free. All you need is an account and to be signed in: no subscription and no credits are required, and the app does not offer any plan. What is described from here onwards — plans, prices, limits — is how it will work once we start charging.

The free access in this phase is temporary and may end at any time. When it ends, the AI features will require a subscription or credits, as described below. Under no circumstances will you be charged for what you have already used during this phase.

This cannot result in any unexpected charge: to pay, you have to make an express purchase in Google Play, and if you buy nothing, you will simply lose access to those two features. The rest of the app keeps working exactly the same and your games stay on your device.

While it lasts, there is still a daily limit of calls per account to prevent automated use. It is generous and does not affect normal use.

3. Plans, prices and fair-use limits

Payments are made through Google Play. The applicable price is always the one Google Play shows at the time of purchase, with the taxes applicable in your country.

The limits are fair-use limits: they are set well above what a tournament player consumes (around 80 calls a year) and their purpose is to prevent automated or commercial use, not to restrict normal use. You can check your consumption at any time in the app, under Settings → Account.

If you reach the limit, the AI features stop being available until the next period. The rest of the app keeps working normally. Limits do not carry over from one period to the next.

Reaching the limit does not leave you stuck: you can buy a credit pack and carry on using the AI without waiting for the renewal. Credits are only spent once the subscription no longer covers the call, so you never pay twice for the same thing.

4. Renewal and cancellation

Subscriptions renew automatically at the end of each period unless you cancel beforehand. Cancellation is done from Google Play (Play Store → Payments and subscriptions → Subscriptions), not from the app.

When you cancel, you keep access until the end of the period already paid for; there is no pro-rata refund of the unused part. Credits bought as a one-off payment do not expire, but neither are they refundable once used.

5. Right of withdrawal and refunds

Refunds are handled by Google Play under its own policy, and you can request them from your Google account. If you are a consumer in the European Union, you have a 14-day right of withdrawal over digital content; that right lapses once performance has begun with your express consent — that is, as soon as you use an AI call. If Google does not grant your request and you believe you are in the right, write to us and we will look into it.

If we detect a pattern of use incompatible with the previous section, we may suspend that account's access to the AI features. The app will tell you so, with a notice and the contact address.

8. The AI makes mistakes: always review

Scoresheet transcription and game analysis are performed by artificial intelligence models, and they may contain errors. The app is designed for you to review the result: it flags doubtful moves, lets you correct them, and takes nothing as final without you.

The result is provided as an aid, not as an official record. We accept no responsibility for the consequences of using a transcription or an analysis without reviewing it, particularly in competition or arbitration contexts.

9. Your content

Your games, your photos and your annotations are yours. We claim no rights over them, we do not publish them and we do not use them to train models. Scoresheet photos are sent to the AI service only in order to process that specific call and are not retained afterwards; the detail is in the privacy policy.

10. Service availability

We do what is reasonable to keep the service available, but we do not guarantee uninterrupted operation: it depends on third parties (Google Play, the AI providers and the hosting). If a prolonged outage prevents you from using what you have paid for, write to us and we will make up for it.

11. Changes to prices and limits

We may change prices and fair-use limits. Changes do not apply retroactively to a period already paid for. If the price of your subscription goes up, Google Play will notify you and you will have to accept it for the subscription to renew; if you do not accept, the subscription ends at the end of the current period. If we reduce a limit, we will give you notice from within the app.

12. End of the service

If we were ever to stop providing the service, we would give reasonable notice, stop charging renewals and refund the unused part of subscriptions in progress. The features that do not depend on the AI would keep working on your device, and you could export all your games to PGN at any time.

13. Governing law and complaints

These terms are governed by Spanish law. If you are a consumer, you keep the rights granted to you by the law of your country of residence in the European Union and you may bring proceedings before the courts of your domicile.

Before that, write to us: most things get sorted out by email. You may also turn to the consumer authorities of your country of residence; if you live in Spain, through consumo.gob.es. If your case is cross-border within the European Union, the Commission lists the available routes at consumer-redress.ec.europa.eu.

14. Changes to these terms

We may update these terms; we will publish the version in force together with its "last updated" date. If the change is significant, we will notify you from within the app.
